Terms of Service

The agreement between you and MyAudioMessage covering accounts, plans, your content and acceptable use.

1.Agreement to these terms

These terms are an agreement between you and the sole proprietor operating MyAudioMessage at myaudiomessage.com (“we”, “us”). By creating an account or using the service you accept them. If you do not accept them, do not use the service.

Our Privacy Policy explains how we handle your personal data and forms part of this agreement.

2.Who may use the service

You must be at least 16 years old and able to enter into a binding contract. If you are using MyAudioMessage for an organisation, you confirm you are authorised to accept these terms on its behalf, and “you” means that organisation.

3.Your account

You are responsible for everything that happens under your account and for keeping your credentials secure. Tell us promptly at jforeman@techsavey.com if you believe your account has been used without your permission.

Accounts are for a single person. Signing in with a third-party provider that uses an email address already registered here links to the existing account rather than creating a new one, so be aware of which address you are using.

4.Plans, allowances and billing

Each plan includes an allowance of completed batches per rolling 30-day window. The window is a moving one: a batch stops counting against your allowance 30 days after it completed.

Paid plans are billed in advance through Stripe and renew automatically until cancelled. Prices are shown on the pricing page and exclude any tax that may apply. If a payment fails we may retry it and may suspend access to paid features until it succeeds.

Changing plans takes effect immediately and Stripe adjusts your next invoice accordingly. We may change prices, and will give at least 30 days’ notice by email before a change affects you; continuing to use a paid plan after that is acceptance of the new price.

5.Cancellation and refunds

You can cancel at any time from your billing page. Cancelling stops future charges and your paid features remain available until the end of the period you have already paid for, after which the account returns to the Free plan.

Payments are not refundable, including for partial periods and for periods in which you did not use the service. This does not affect any right to a refund you have under the law of your country that cannot be excluded by agreement. If you believe you have been charged in error, contact jforeman@techsavey.com and we will look into it.

6.Your content

You keep ownership of everything you upload and everything we generate from it. We claim no rights over your audio.

To run the service we need your permission to do specific technical things with your files. You therefore grant us a limited, non-exclusive, worldwide, royalty-free licence to store, copy, transcode, combine and transmit your content solely to provide the service to you — to process your batches, store the results, and deliver them to you or to anyone you give a share link. This licence exists only so we can operate the service, ends when you delete the content, and grants us no right to use your audio for anything else. We do not use it to train models and we do not licence it to anyone.

You are responsible for having the rights to everything you upload, including any rights in a recorded voice or in music, and for any consent required from people who can be heard in it.

7.Deleting and archiving

Deleting a batch removes its stored outputs. Archiving a batch is not the same as deleting it: an archived batch is permanently deleted 7 days after it is archived, automatically and irreversibly. Download anything you want to keep before then. We are not able to recover deleted content, so keep your own copies of anything important.

8.Batches that fail or are cancelled

A batch that fails or that you cancel does not count against your allowance. We keep it for 24 hours so you can retry it, and then delete it and anything it produced, automatically.

9.Share links

A share link lets anyone who has it download that batch without signing in. You choose whether to create one and whether to give it an expiry date, and you can revoke it at any time. Treat a share link like a password: we cannot control or recover copies that were downloaded while the link was live, and you are responsible for who you give it to.

10.API and connector access

Pro accounts can generate API keys and connect MyAudioMessage to compatible AI assistants through our connector. An API key acts as your account — anything done with it is treated as done by you, so keep it secret and revoke it from your billing page if it is exposed. We may apply rate limits, and may change or withdraw connector features as the underlying standards change.

11.Acceptable use

You agree not to use MyAudioMessage to:

  • upload content you do not have the rights to use;
  • impersonate a real person, or create audio designed to deceive people about who is speaking;
  • produce harassing, threatening, defamatory or unlawful material;
  • send bulk unsolicited messages, or support any operation that does;
  • break, overload, probe or circumvent the service, its rate limits, its quotas or its access controls;
  • access another account’s batches, segments or outputs; or
  • resell or redistribute the service as your own.

12.Availability

We work to keep MyAudioMessage running but do not promise any particular uptime. The service may be unavailable for maintenance, for changes, or for reasons outside our control, and we may add, change or remove features. If we discontinue the service altogether we will give you reasonable notice and time to download your content.

13.Suspension and termination

You may stop using the service at any time and ask us to close your account by emailing jforeman@techsavey.com. We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used unlawfully, or where required by law. Where it is reasonable to do so we will warn you first and give you a chance to put things right. Sections 6, 13, 14, 15 and 16 survive termination.

14.Disclaimers

The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that generated audio will meet your requirements. Nothing here excludes a warranty that cannot be excluded under the law that applies to you.

15.Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost data. Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

16.Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your content, your use of the service, or your breach of these terms — including any claim that something you uploaded infringed someone else’s rights.

17.Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules, and the courts of that state have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of mandatory laws in your country of residence.

18.Changes to these terms

We may update these terms as the service changes. The date at the top always reflects the current version. If a change is material we will give you reasonable notice by email or in the app; continuing to use the service afterwards means you accept the updated terms.
